Understanding the Legal Process for Sexual Abuse Cases in New York

The legal process for filing a sexual abuse lawsuit in New York consists of several stages. While every case is unique, the following steps provide a general overview of the process:

  1. Initial Consultation: Contact an experienced sexual abuse lawyer to discuss your case and explore your legal options. During a free, confidential consultation, the attorney will evaluate the merits of your case and advise you on the best course of action.

  2. Investigation: If you decide to proceed with a lawsuit, your attorney will thoroughly investigate the circumstances surrounding your case. This may involve gathering evidence, interviewing witnesses, and identifying potential defendants. The lawyer may also consult with experts to help build a strong case on your behalf.

  3. Filing a Lawsuit: Your attorney will file a civil lawsuit against the responsible parties. In New York, there are specific time limits, known as statutes of limitations, for filing sexual abuse claims. Your lawyer will ensure that your case is filed within the appropriate timeframe.

  4. Discovery: The discovery phase involves the exchange of information and evidence between both parties. Your attorney will use this process to gather additional evidence, request documents, and depose witnesses to strengthen your case.

  5. Negotiation and Settlement: Many sexual abuse cases are resolved through settlement negotiations without going to trial. Your attorney will negotiate with the defendant's legal team to secure the maximum compensation for your pain, suffering, and other damages. If a fair settlement cannot be reached, your lawyer will be prepared to take your case to trial.

6. Trial: If your case goes to trial, your attorney will present your case before a judge and jury. They will advocate for the justice and compensation you deserve, using the evidence and testimony gathered during the discovery process. Trials can be lengthy and complex, but an experienced trial attorney will guide you through the process.

7. Post-Trial and Appeals: After the trial, there may be post-trial motions or appeals from either side. Your attorney will handle any necessary post-trial proceedings and, if required, represent you during the appeal process.

It is important to remember that the legal process can be lengthy and emotionally challenging. Working with an experienced and compassionate sexual abuse lawyer can provide you with the support and guidance needed to navigate the complexities of the legal system and pursue justice for the harm you have suffered.

The New York Child Victims Act - Assistance For Childhood Sexual Abuse

The Child Victims Act (CVA) is a significant piece of legislation in New York State that expands the rights of childhood sex abuse survivors by extending the statutes of limitations for both criminal and civil cases. Signed into law by Governor Andrew Cuomo on February 14, 2019, the CVA aims to provide survivors with more time to seek justice and hold their abusers accountable.

Key provisions of the Child Victims Act include:

  1. Extended Statute of Limitations for Criminal Cases: The CVA extends the statute of limitations for felony child sexual abuse offenses. Survivors can now file criminal charges against their abusers until they turn 28 years old (previously, the age limit was 23).
  2. Extended Statute of Limitations for Civil Cases: The CVA significantly extends the statute of limitations for civil lawsuits related to child sexual abuse. Child sexual abuse victims can now file a civil claim against their abusers or responsible institutions until they reach the age of 55.
  3. One-Year "Lookback Window" (now expired): The CVA initially included a one-year "lookback window," which allowed survivors of any age to file civil lawsuits against their abusers or responsible institutions, regardless of when the abuse occurred. This provision aimed to provide justice for survivors who were previously unable to file a lawsuit due to the statute of limitations. The lookback window opened on August 14, 2019, and was later extended by Governor Cuomo until August 14, 2021, due to the COVID-19 pandemic.
  4. Notice of Claims: The CVA also amended the notice of claim requirements for public institutions, enabling survivors to file lawsuits against public entities such as schools and government agencies. Under the CVA, a notice of claim is not required for child sexual abuse cases.

The Child Victims Act has been a significant step forward in providing justice to survivors of child sexual abuse in New York State. By extending the statutes of limitations for both criminal and civil cases, the CVA enables survivors to seek accountability and compensation from their abusers, even if the abuse occurred many years ago.
