Hi - I'm Guy. I am an attorney that practices in Pennsylvania. I am a former sex crimes prosecutor and my day-to-day cases are almost exclusively helping survivors of sexual abuse get justice. My team and I are ready to help.
The family of Malinda Hoagland, a 12-year-old girl who tragically died in May 2024 after allegedly enduring years of abuse, has filed multiple child abuse lawsuits in Pennsylvania against various agencies they claim failed to protect her. The legal action seeks to hold accountable those who allegedly missed critical red flags that could have prevented Malinda's untimely death.
According to investigators, Malinda suffered severe abuse and torture at the hands of her father, Rendell Hoagland, and his girlfriend, Cindy Warren. The girl weighed only 50 pounds at the time of her death, showing signs of extreme malnutrition. Authorities reported that some of the horrific abuse was captured on surveillance cameras inside the couple's Chester County home.
The lawsuits target several entities, including:
The family alleges these agencies failed in their duty to protect Malinda despite apparent signs of abuse.
Tom Bosworth, the attorney representing Malinda's adult half-sisters, highlighted several critical points:
The family's legal action aims to seek justice for Malinda and drive systemic changes. They hope the lawsuit will spur the creation of a national registry of child abusers, similar to Megan's Law.
Rendell Hoagland and Cindy Warren are currently in custody, charged with murder. The Chester County District Attorney has announced intentions to seek the death penalty in this case
Guy D'Andrea, Esq. of Abuse Guardians, comments: "The Malinda Hoagland case is a heartbreaking example of how systemic failures can lead to tragic outcomes for vulnerable children. These lawsuits serve a crucial purpose beyond seeking compensation – they aim to expose gaps in our child protection systems and push for meaningful reforms. All agencies involved in child welfare must be held to the highest accountability standards. As attorneys, we must continue to advocate for stronger protections and more rigorous oversight to prevent such devastating cases in the future."
