A hospital in Lancaster, Pennsylvania has been cited for dismissing one case of sexual assault and concealing three others. Officials for the Pennsylvania Department of Health say Penn Medicine Lancaster General Health has failed to uphold its obligations under state law, according to ABC 27.
In September 2018, Department of Health authorities paid a surprise visit to Lancaster General Health in the wake of a sexual assault allegation. According to state regulators, officials at the hospital said the allegations against Shawn Moyer, a pulmonary therapist, were unfounded. But police took a different view of events, charging Shawn Moyer for sexual assault. Authorities say Moyer inappropriately touched an unconscious patient.
While investigating the hospital, state regulators found evidence of at least three additional sexual abuse complaints, none of which had been reported to the proper authorities. In its report on the matter, the Pennsylvania Health Department accused Lancaster General Health of failing to have a proper protocol in place to ensure that investigations were thorough. "This failure," the report reads, "placed the patients who alleged the abuse and other patients in the hospital that may have had contact with the staff member in question, at risk."
Shawn Moyer has now been placed on administrative leave from the facility. Lancaster General Health has also submitted an action plan, accepted by state regulators on November 14, 2018, to strengthen the hospital's sexual abuse response and reporting program. At this moment, no criminal charges have been leveled against any hospital supervisors.
Thankfully, Shawn Moyer is being held accountable for his alleged misconduct by the criminal justice system. Following an investigation led by Detective Harnish, Moyer has been charged with abuse of a care-dependent person, indecent assault, open lewdness, indecent exposure and invasion of privacy. Moyer was arrested at the hospital on November 8, 2018 and, at last report, was being held at Lancaster County Prison in lieu of $250,000 bail.
According to the Lancaster Bureau of Police, the alleged sexual assault involving Shawn Moyer occurred on September 12, 2018 inside a patient care room. An adult male patient woke suddenly when he felt someone else touching his genitals. When the victim opened his eyes, he saw a hospital employee, unknown to the victim, with his own penis exposed. The suspect quickly ran from the room, but was later identified by investigators as Shawn Moyer.
